Intellectual Property

Athletes, artists, and brands need intellectual property protections to safeguard their unique creations, identities, and innovations.

For athletes, this could include protecting your name, image, and likeness in endorsement deals. For artists, it helps ensure your creative works—like music, art, and performances—aren’t copied or exploited without permission. For brands, intellectual property protection secures your logos, slogans, and other brand assets from unauthorized use. These protections prevent infringement, preserve the value of your creations, and allow you to maintain control over how your work is used, helping you maximize revenue and avoid legal challenges.

Copyrights

Copyrightable works receive copyright protection as soon as they are created, but you still need to take additional steps to enhance such protections to ensure you can enforce your rights and defend against infringement.

Additional methods for enhancing your copyright include:

  • Registering it with the United States Copyright Office

  • Using a Copyright License Agreement when allowing third-party use of your copyright(s)

  • Using a copyright notice to inform the public

  • Making sure your contracts adequately disclaim use of your copyright(s)

  • Taking steps to enforce against infringement

Salis Legal can assist you with all of these methods to ensure that your copyrightable works are protected. Salis Legal’s copyright services are billed at an hourly rate, currently $250 per hour of work performed in copyright matters.

Trademarks

While your logo, name, or slogan might receive some “common law” protection simply for using the same, seeking federal trademark registration with the United States Patent and Trademark Office offers significant advantages including much broader coverage and protection. Registering a trademark with the USPTO provides notice to consumers and competitors that you are the owner of your mark, making it easier to defend against infringement and unauthorized use, preventing others from using similar marks that could confuse your consumers or damage your brand’s reputation, and establishing a legal presumption that you own the trademark.

In addition to the legal protections afforded to you and your brand, a strong federal trademark is a very valuable asset in the sale of a business. Salis Legal can assist you with every step of the process, including performing clearance searches to assess the viability of obtaining your preferred trademark(s), applying for your preferred trademark(s), responding to USPTO office actions, ensuring proper maintenance and renewal of your registered trademarks, monitoring for infringement and new trademark applications that are confusingly similar to your registered trademarks, and sending cease and desist letters to infringers.

Salis Legal offers a Full Trademark Application Package for $2,499 (*not including filing fees) which includes the following:

  • A one-on-one (up to one hour) discovery call with a Salis Legal attorney at the outset

  • A comprehensive search and opinion letter advising you of the feasibility of registering your preferred trademark

  • Filing your trademark application with the USPTO

  • Response to all administrative office actions (substantive and procedural)

  • A second, one-on-one (up to one hour) call with a Salis Legal attorney at any stage in the process to answer additional questions

*USPTO filing fees are currently $350 per class (multiple classes may be required, determined on a case-by-case basis)

Any of these items included in our full trademark application package can be done à la carte depending on where you are in the process. Please contact us for pricing.

Additional trademark services include but are not limited to reviewing your contracts and marketing materials to ensure appropriate use and protection of your registered trademarks, advising you to ensure that you do not infringe on federally registered trademarks, and enforcing your trademarks against infringing uses.
